Terms & Conditions
Scope of Work
TBP Windows & Doors (“TBP”) agrees to furnish and install the products described in the estimate/contract. Scope includes only items specifically listed. Any additional work, modifications, or unforeseen conditions will require a written change order and may result in additional charges and schedule adjustments.
Products & Materials
All windows, doors, glass, and related materials are ordered based on approved specifications.
Customer Acknowledges
- All products are custom or special order unless otherwise stated.
- Sizes, configurations, glass types, and finishes must be reviewed and approved prior to ordering.
- Changes after order placement may result in additional costs or delays.
Glass Quality & Inspection Standards
All glass products supplied by TBP shall meet applicable industry standards, including ASTM C1036. Glass shall be inspected from approximately 10 feet under normal lighting conditions (not direct sunlight or spotlighting) and at a 90-degree angle.
- Minor blemishes (seeds, bubbles, scratches, slight distortions) are acceptable if they do not materially obstruct vision.
- Imperfections not visible under these criteria are not considered defects.
Tempered Glass & Distortion
Tempered or heat-strengthened glass may exhibit slight waviness, roller marks, or optical distortions inherent in manufacturing. Such distortions are not defects.

Manufacturing Tolerances
Measurements & Field Verification
TBP will take field measurements prior to ordering when included in scope. TBP is not responsible for errors if customer or third-party measurements are used.
Pricing & Validity
Pricing is valid for thirty (30) days and may change due to:
- Manufacturer price increases
- Tariffs or supply chain changes
- Site conditions or scope revisions
Payment Terms
- Deposit due upon acceptance
- Progress payments may be required
- Balance due upon substantial completion
Late payments may result in:
- Interest up to 18% per annum (or max allowed by Texas law)
- Suspension of work
- Collection costs, including attorney’s fees
Texas Mechanic’s Lien Notice (Required)
Under Texas law, contractors and suppliers who furnish labor or materials for improvements may file a mechanic’s lien if not paid, even if you have paid your contractor.
To protect yourself
- Request lien waivers from TBP and suppliers
- Ensure all parties are paid
Failure to comply may result in a lien against your property.
Permits & Code Compliance
Unless otherwise agreed:
- Customer is responsible for permits and inspections
- TBP work will follow standard industry practices
- Code upgrades or corrections are not included unless specified
Installation Conditions
Customer agrees to:
- Provide clear access to work areas
- Remove furniture, coverings, and valuables
- Ensure utilities are available
TBP is not responsible for:
- Damage to finishes (stucco, drywall, paint, trim, flooring) required for installation
- Water intrusion due to pre-existing conditions
- Structural deficiencies or improper prior construction
Lead Paint & Hazardous Materials
For homes built before 1978, potential presence of lead paint is acknowledged. TBP will follow regulations if included in scope; otherwise, remediation is not included.
TBP is not responsible for:
- Mold, asbestos, or hazardous materials
- Costs associated with remediation
Scheduling & Delays
Installation dates are estimates. Delays may occur due to:
- Material availability
- Weather or labor conditions
- Site readiness or manufacturer delays
TBP is not liable for delays beyond its control.
Change Orders
All changes must be:
- In writing
- Signed by both parties
Verbal changes are not valid and may affect price and schedule.
Warranty
Manufacturer Warranty: All products carry manufacturer warranties.
TBP Workmanship Warranty: TBP provides a 1-year limited workmanship warranty covering installation defects only.
Exclusions:
- Normal wear and tear
- Glass breakage or seal failure (covered by manufacturer)
- Improper use or maintenance
- Structural movement or building settling
Punch List & Completion
Customer agrees to a final walkthrough. Minor punch list items do not delay final payment.
Damage & Liability
TBP will take reasonable precautions. TBP is not responsible for:
- Damage to concealed plumbing, electrical, or framing
- Landscaping or exterior areas
- Cosmetic interior/exterior repairs (unless specified)
Liability is limited to the contract amount.
Ownership & Risk of Loss
Materials remain TBP property until paid in full. Risk of loss transfers upon delivery to the site.
Cancellation
- Must be in writing
- Deposits are non-refundable once materials are ordered
- Customer responsible for costs incurred
Custom orders cannot be canceled once in production.
Right to Stop Work
TBP may stop work if:
- Payments are not made
- Site conditions are unsafe
- Customer interferes with work
Dispute Resolution
Disputes will be resolved via:
- Good-faith negotiation
- Mediation
- Binding arbitration in Texas
Entire Agreement
This document, along with the estimate and change orders, constitutes the entire agreement.
